Welcome to Outdoorithm! These Terms of Service ("Terms") govern your access to and use of our website, products, and services ("Services"). Please read these Terms carefully, and contact us if you have any questions. By accessing or using our Services, you agree to be bound by these Terms and by our Privacy Policy.
1. Use of Services
1.1. You must be at least 13 years old to use our Services.
1.2. You are responsible for your use of the Services and any content you provide, including compliance with applicable laws, rules, and regulations.
1.3. We may discontinue or change any part of the Services at any time without prior notice.
1.4. Campsite Availability Notifications: As part of our Services, Outdoorithm may offer campsite availability notifications. By opting into this feature, you agree to receive text messages or emails regarding the availability of campsites you are interested in.
- You must provide explicit consent to receive these notifications and can opt out at any time.
- Message and data rates may apply depending on your mobile carrier plan.
- You acknowledge that opting in to receive messages is not a condition for purchasing any goods or services.
2. Content
2.1. You retain your rights to any content you submit, post or display on or through the Services. By submitting, posting, or displaying content on or through the Services, you grant us a worldwide, non-exclusive, royalty-free license (with the right to sublicense) to use, copy, reproduce, process, adapt, modify, publish, transmit, display, and distribute such content in any and all media or distribution methods (now known or later developed).
2.2. We reserve the right at all times (but will not have an obligation) to remove or refuse to distribute any content on the Services, to suspend or terminate users, and to reclaim usernames without liability to you.
3. Privacy
3.1. Our Privacy Policy describes how we handle the information you provide to us when you use our Services. You understand that through your use of the Services, you consent to the collection and use of this information as set forth in the Privacy Policy.
4. Respect for the Community
4.1. Outdoorithm is dedicated to making camping adventures accessible for everyone. To preserve the welcoming and inclusive nature of our community, we do not tolerate discrimination, harassment, or harm towards any user.
4.2. Users are expected to respect each other, the community, and the environment.
5. Custom Trip Planning Services
5.1. Outdoorithm provides custom trip planning services for camping and outdoor adventures. This includes location recommendations, reservation guidance, gear lists, activity suggestions, and meal planning.
5.2. Payment: Full payment is required before the custom trip planning process begins. Fees are non-refundable once the planning process has started.
5.3. Reservation Responsibility: While Outdoorithm provides guidance on making reservations, the client is solely responsible for securing their own campsite or accommodation reservations. Outdoorithm is not liable if the client is unable to secure a reservation at their preferred location or dates.
5.4. Trip Cancellation: Outdoorithm is not responsible for any costs or losses incurred if the client needs to cancel or postpone their trip for any reason, including but not limited to personal circumstances, weather conditions, natural disasters, illness, or injury.
5.5. Trip Outcomes: While Outdoorithm strives to provide accurate and helpful information, we cannot guarantee specific outcomes for any trip. The client acknowledges that outdoor activities involve inherent risks and that actual experiences may differ from expectations due to factors beyond our control.
5.6. Liability Waiver: By using Outdoorithm's services, the client agrees to waive any claims against Outdoorithm for injuries, damages, or losses sustained during their trip. This includes but is not limited to personal injury, property damage, or any other negative outcomes related to the planned trip.
5.7. Information Accuracy: Outdoorithm makes every effort to provide up-to-date and accurate information. However, we cannot be held responsible for any errors or changes in information provided by third-party sources (such as campgrounds, parks, or activity providers).
5.8. Client Responsibility: The client is responsible for their own safety and well-being during their trip. This includes following all local laws, regulations, and safety guidelines, as well as using common sense and good judgment in outdoor settings.
5.9. Health and Fitness: Clients are responsible for ensuring they are physically fit and healthy enough to participate in the activities suggested in their custom trip plan. Outdoorithm is not liable for any health issues that may arise during the trip.
6. Intellectual Property
6.1. All content, designs, and materials provided in the custom trip plans remain the intellectual property of Outdoorithm and cannot be resold or distributed without our express written permission.
7. Force Majeure
7.1. Outdoorithm is not liable for failure to perform its obligations if such failure is as a result of Acts of God (including fire, flood, earthquake, storm, hurricane or other natural disaster), war, invasion, act of foreign enemies, hostilities (regardless of whether war is declared), civil war, rebellion, revolution, insurrection, military or usurped power or confiscation, terrorist activities, government sanction, blockage, embargo, labor dispute, strike, lockout or interruption or failure of electricity or telephone service.
8. Dispute Resolution
8.1. In the event of any dispute arising from or relating to these Terms or the Services, the parties shall first attempt to resolve the dispute through good-faith negotiation. If the dispute cannot be resolved through negotiation, both parties agree to resolve the dispute by binding arbitration, rather than in court, except that you may assert claims in small claims court if your claims qualify.
9. Modifications
9.1. We may revise these Terms from time to time, and will always post the most current version on our website. If a revision meaningfully reduces your rights, we will notify you.
10. Limitation of Liability
10.1. In no event shall Outdoorithm, its directors, employees, or agents be liable for any direct, special, indirect or consequential damages, or any other damages of any kind, including, but not limited to, loss of use, loss of profits or loss of data, whether in an action in contract, tort (including but not limited to negligence), or otherwise, arising out of or in any way connected with the use of our services.
11. Governing Law and Jurisdiction
11.1. These Terms shall be governed by the laws of the state of California, without respect to its conflict of laws principles.
12. Severability
12.1. If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that the Terms will otherwise remain in full force and effect and enforceable.
13. Refund Policy
13.1. All fees paid to Outdoorithm, including but not limited to custom trip planning fees, membership fees, e-guide purchases, and any other services or products offered by Outdoorithm, are non-refundable.
14. Assignment
14.1. These Terms, and any rights and licenses granted hereunder, may not be transferred or assigned by you, but may be assigned by Outdoorithm without restriction.
15. Entire Agreement
15.1. These Terms constitute the entire agreement between the parties with respect to the subject matter hereof and supersede and replace all prior or contemporaneous understandings or agreements, written or oral, regarding such subject matter.

By using the Services, you acknowledge that you have read, understood, and agree to be bound by these Terms of Service. If you do not agree to these Terms of Service, do not use the Services.
